A generic set of initial data recently proposed by Hertog, Horowitz and Maeda, within the asymptotically anti deSitter, spherically symmetric, class of spacetimes in Einstein scalar field theory, has been argued will evolve toward a singularity that can not be contained within a black hole. We will argue that there is a logical loophole in the argument associated with the supposition that the end state needs to be a stationary spacetime. We then describe a physically reasonable possibility for the evolution of the data that would allow the singularity to be contained within a black hole.
