It is argued that the 'Fermi paradox', the contention that extraterrestrial intelligence (ETI) cannot exist because it has not yet been observed, is a logical fallacy. Where A = ETI exist, B = ETI are here, and C = ETI are observed, the inference: If A, then probably B; If B, then probably C; Not-C; Therefore not-B; Therefore not-A is both syntactically and semantically invalid because 'probably' is a modal truth functional operator outside the scope of the first-order propositional calculus. Furthermore, not-C is not certainly true on the basis of available evidence. The possibility that ETI exist in the solar system but have not yet been observed is discussed.
