In this paper we study the thermal regime of these celestial bodies to clarify the possibility of existence of ice in the upper layer. The regolith is considered as a disperse system formed by a mass of solid particles of the main material (the skeleton of the system) and the voids between them. It makes easier to consider the process of the heat transfer in the regolith of different structures including pure ice and permafrost. For the heat transfer we take into account the peculiarities of insolation at different latitudes and longitudes as well as the existence of the subpolar region of Mercury end the Moon. It is study the dependence of these conditions on the structure, composition and thickness of the dry top layer.
