The first time the U.S. Government wanted to restrict image dissemination under the new regulations for private U.S. earth observation systems, the system operator and the Government entered into a contract that gave the Government exclusive rights to the imagery. The contract mechanism used has been at the center of much controversy, and has also raised questions regarding the first amendment guarantees of the United States Constitution. This paper addresses whether or not the regulations provided for such a contract, whether or not the contract was properly executed, and what regulatory modifications may be considered for future applications of the regulations under similar circumstances.
