The instability or damping of the ordinary and extraordinary electromagnetic modes propagating at nearly perpendicular angles to the earth magnetosphere are considered in terms of a particle distribution function, including factors of a loss-cone structure and temperature anisotropy. Expressions are derived for the components of the polarisability tensor and a dispersion equation is defined for the oblique propagation of electromagnetic modes. Both types of modes are found to be weakly damped in addition to having wavelengths of several kilometers in magnetospheric conditions. The loss-cone factor was found to have no effect on the wavelength or the damping of the waves.
